Use

After 5 years after filing the trademark, the trademark remains only valid for the registered goods and services actually used. The proof of this trademark use is cumbersome and complex. Sometimes the trademark owner has not collected the right evidence and therefore, when requested to, is not able to prove use. Such a proof is required for example when enforcing your trademark against a competitor, when opposing against a younger trademark or when a nullity action is filed against your trademark for non-use. Therefore, we recommend and remind our clients to periodically collect evidence of actual use of your trademark. We check the collected evidence for completeness to ensure a strong trademark protection.
